The following terms and conditions apply to all purchases from Emerald Isle Produce Ltd, known as the supplier, and yourselves referred to herein as the customer.
The Company
Emerald Isle Produce domain names (dot ie, dot com, and dot co.uk) are registered domain names of Emerald Isle Produce Ltd, Registered in Ireland, a privately owned limited company. The company has also registered the company name, throughout a variety of countries and retains registered trade marks of its logo’s. We retain copyright of all images and text contained in our advertising materials and website.
Quotations/Prices
Quotations are provided to all customers free of charge, and are given on the basis of prices at the time of issue. Prices may be amended to reflect increases or fluctuations and/or any alteration in the rate of VAT, or excise duty. Individual quotations are valid for a period of 21 days from issue.
All VAT rates are shown on our invoice, or shown on our internet shop cart display when ordering. All prices quoted on our internet site show VAT within the price.
For customers ordering in bulk for corporate purposes, we adjust delivery charges and quote a special rate reflecting a one bulk consignment.
Delivery
General information
Delivery charges for orders delivered within Ireland are included within the price for our standard delivery service. This service reaches you 48hrs from dispatch from our premises. Express courier delivery charges are shown as a nominal charge thereafter. Additional delivery surcharges for Britain and Europe are shown separately at checkout or within the enlarged description page linked to each product. Please telephone, or email for a quote on all dispatches beyond the European Union. Due to import restrictions, some countries beyond the EU, do not permit the import of certain food stuffs and may restrict certain alcoholic products. We can customize a gift package to suit.
Greeting card/inclusions
To personalise the gift you are sending, we accept inclusions such as greeting cards and or complement slips. However, whilst we acknowledge by e-mail, the arrival of such, we cannot accept responsibility of the none -arrival whereby it affects our ability to service your order for delivery on a due date. Should this effect, a pre-advised delivery date, we reserve the right to dispatch the goods, and include one of our own exclusive cards.
Christmas
Throughout December, deliveries for specific days cannot be fully guaranteed. We advise to orders for delivery prior to Christmas be placed before the 10th December. Please note, as this is an exceptionally busy period, we advise that all Christmas Gift orders are placed well in advance to avoid disappointment. Due to popular demand, 30/45 days prior notice is not unusual.
Requested Delivery Dates
Ours is a service based company, we will endeavour to uphold your requests where ever and when ever practical. The more notice we have, the greater the possibilities of attending and fulfilling your request with ease. For specific dates of importance to yourself, or family members, such as birthdays and anniversaries, we ask that a minimum of 5 working days notice is provided to guarantee fulfillment. However, if this is not possible, please contact a member of our customer services team, who will be able to qualify how best we can ensure your gift reaches its destination on the day.
Proof of Delivery
Proof of delivery by our designated carrier, shall be sufficient evidence that delivery has been fulfilled. Where normal inland postal services are utilised for small dispatches, receipt of postage is confirmation of our dispatch. When express couriers are utilised it is possible to track the progress of consignments. By contacting our customer service team we can provide tracking numbers and information relating to a particular dispatch.
It is incumbent upon all our customers to provide correct address and telephone numbers, and post/zip codes at time of ordering. Regrettably, we cannot accept responsibility for non-delivery if the recipients address or telephone details are insufficient or incorrect. Any notification of non delivery must be made in writing/e-mail within 10 days.
Where, a delivery cannot be made as the recipient is out or away from the premises, our designated carrier will leave a post card indicating that the package has been left with a neighbour, or that the carrier will call again the following day. A contact number will also be left, whereby arrangements for delivery can be finalized between the two parties. If after 3 days, delivery has been un-successful, our designated carrier may request that the item be collected from a nearby distribution depot.
Non- Arrival
In the unlikely event of a consignment not reaching its intended destination please contact Emerald Isle Produce, Customer Services Dept, providing details of the order number and intended destination shown on the invoice paperwork.
Damages
We take every care in our packaging process bubble wrap fragile items individually, thereby reducing the possibility of breakages during transit. The company shall only be responsible for replacement of a damaged item from with in a gift hamper, and where a gift box is purchased we request the return the item. A pre-paid postal slip will be dispatched to you for this purpose. Any such breakages or damages should be notified to us by e-mail within 48hrs of receiving the goods.
We reserve the right to in-act such replacement with same, similar, or product of equivalent value, as are currently available and with due consideration to our clients particular needs.
Chilled/Vacuum Packed Produce
All vacuum packed fresh produce is stored chilled at our warehouse, expanding its shelf life as indicated on best before date shown on the pack. All such produce is packed for dispatch together with a chiller pack or ice pack. This is to keep the product at a near chilled/ refrigerated temperature. Although, by the nature of vacuum packed produce, such items have a natural 10 day shelf life un-chilled.
Substitution
All items are offered subject to availability. In both our delicatessen, gift box or hamper service. If due to unforeseen circumstances, or season reasons, it may be necessary to substitute an item in a hamper. This will constitute the replacement of an item by one of equal, or greater value, than the item it replaces. And the same conditions apply if a product constitutes a supporting product within a gift box product.
Where we have quoted a specific brand name that constitutes the main offer in a gift box, and for reasons beyond our control this becomes unavailable to us, we will inform you by e-mail, naming a substitution of equal or greater value. We will inform you of choice, This may constitute a continue of your order with a replacement product, an opportunity to make another selection, or to in-act a refund.
Limitations
The company shall not be liable or responsible for any personal injury, consequential or inconsequential loss or damage to property however caused. Alcohol cannot be sold to persons under the age of eighteen years of age.
Interpretation
These terms and conditions and their interpretation shall be in accordance with the laws of Ireland and the parties submit to the exclusive jurisdiction of the Irish Courts in resolution of any issues.
Photographs, Images and descriptions
Photographs and images in our brochure or website are accompanied by an itemized list of contents. Other than packaging materials such as wood wool, for photographic purposes some props have been used which are not included in our gift boxes and hampers.
Withholding Goods & Services
Emerald Isle Produce Ltd, reserves the right to refuse to supply any individual, organization/company and also reserves the write to deny access to web sites and promotional literature.
Telephone calls
All telephone calls may be recorded for security and service monitoring purposes. Our operators reserve the right to terminate a call, on the grounds of unreasonable o,r abusive language, or behaviour.
Acceptance of these Terms and Conditions.
Your use of our brochures, website and ordering facilities constitutes your agreement to our terms and, to be bound by these. The company reserves the right to periodically, review our terms and may make amendments at any time without the necessity for prior notice. In agreeing to these terms there is an acceptance on the part of the customer that we have ability the reply and contact you by e-mail and other communication methods for such purposes as the company considered appropriate.
Data Usage Policy
In order that we can fulfills customer requirements and have a better understanding of our customers needs, we reserve the right to retain information provided in the course of your purchase, and to offer products and services that are likely to be of interest in the future. We may carry out market research, by letter telephone, e-mail or any other reasonable method of communication. Occasionally, we will pass details on to other Emerald Isle Produce, associated companies. However, we have a commitment to not sell-on or pass on your information to any other organization that is not directly associated with us.

International Deliveries and Customs Clearance
For international deliveries beyond the EU, we provide guidance and advice on shipping and delivery for all our items. As rates of duty on alcohol varies from country, all our international quotations include the duty payment required for the country of destination and this is pre-paid as part of your quotation to enable goods clearance. However, we cannot be held responsible after all due care, should a local customs authority wish to confiscate any particular item, delay shipping/freight or charge additional import duty on any gift boxes or hampers.
